Rental Agreement
By accessing to use this website or to place an order with us, you understand and agree to enter into the following rental term whether or not you have read them. If you do not agree to any term or condition, you should not use this site.All prices and availability are subject to change without notice. Top lens Rental reserves the right to correct errors as needed.
First timer renter please click here to access the rental document from. This form must be signed and faxed to Top Lens Rental before any rental item released. Top Lens Rental reserves the right to rent, to cancel any order for any reason at any time to any person or business.
Rental Period
The rental period is shown on your order summary and invoice. The first rental day begins with the first attempt by UPS to deliver the rental item(s). Renters must return the item(s) during business hours on the last day of the rental agreement. If the last day of the rental agreement falls on a UPS Holiday, the next UPS working day shipping extension will be automatically given with no additional cost.
Shipping
Our standard shipping includes a 2 Day insured UPS shipping that covers both directions at the renters’ expense. An adult signature is required upon receipt. Top Lens Rental is not responsible for delays caused by UPS or other carriers. It is critical that the rental equipment be received by the assigned date; therefore, we suggest shipping at least 2 days in advance. Please note that we do not ship rental item(s) on weekends or on Federal Holidays. For specific shipping methods in your area, please review the FAQ section.
Late Fee
If renters do not return the item(s) by the required return date, regardless of the reason, late fees will be assessed as to that item as follows:
- One (1) Day Late; 30% of 1 week rental fee for that item will be added to the total fees.
- Seven (7) Days Late; the item will be considered stolen and the full retail amount of the item will be added to the total fee, unless an extension arrangement has been made before the return due date.
Please note that the extension arrangement(s) may or may not be available for current renters because it will depend on our stocking availability. Please note that the renter is still responsible for the entire late fee even though the rental term is extended.
Deposit & Documentation
A credit card deposit for the full replacement value of equipment is required. Checks and cash are not accepted. The deposit is returned upon return of equipment in the same condition as when originally rented out, less any amount owned on rental fees, equipment lost, stolen or missing, damages, repair fees and broken parts. All rentals require a clear photocopy of the front and back of a valid driver’s license, another form of ID (employee ID, student ID…), and credit card.
All Deposits if applicable must pay in full and before releasing equipment.
Cancellation
There is no cancellation fee when the rental order is cancelled within 24 hours after placing the order or 7 days before the ship or pickup date by informing us via email or telephone.
A cancellation fee will be charged when contacting us to cancel your order past the cancellation time frame. The cancellation fee will be 28% of your total rental fee.
Damage or Loss
The renter is solely responsible for loss or damages of rental equipment, while in the renter’s possession. TopLensRental.com only rents equipment in working condition. All equipment is tested before sending it out and after receiving it. If the renter has not informed TopLensRental.com of damages within 5 hours of receiving the equipment by phone (during our business hours) or email (after the business hours), the renter agrees the equipment was received in good working condition. After 5 hours of receiving the equipment, damage reported will be considered damaged caused by the renter during the rental period and appropriate charges will be billed to the renter.
If the renter purchased Damage insurance, the renter will only pay a deductible (12% of the lens’ sale price). Renter shall see that the equipment is not subjected to careless, unusually or needlessly rough usage.Pleasenote LOSS, THIEF and damage caused from LIQUID, SAND, or any ABUSIVE, or NEGLIGENT USE are not covered by the accident damage waiver.
Renters shall bear the risk of LOSS, THEIFT, or DAMAGES for all rented equipment and agrees to compensate Top Lens Rental for full replacement of any equipment lost, stolen, missing, or damaged.
Equipment should be repaired only through Top Lens Rental; renter should never attempt to repair, modify, and alter any equiment with their own resources. If equipment is returned in need of repair or restoration, Top Lens Rental will secure the full replacement value of equipment on renter’s credit card along with daily rental fees until repairs or restores are completed.
Any equipment not returned within 7 days from the due date without prior notice by renter may be considered lost, stolen or missing unless arrangements have been made to extend the rental term. The renter’s credit card will be charged for 100% of the equipment replacement value.
WITHIN 24 HOURS IF WE CAN NOT SUCCESFULLY CHARGE THE RENTER’S CREDIT CARD, THE DEFAULT TERMS SHALL BE APPLIED.
In case the renter claims the equipment malfunctions, the statement of the factory service center will be used as a guideline to determine equipment failure or damage.
Liability
TOPLENSRENTAL, BEING NEITHER THE MANUFACTURER, NOR A SUPPLIER, NOR A DEALER IN THE EQUIPMENT, MAKES NO WARRANTIES, EXPRESS OR IMPLIED, AS TO ANY MATTER WHATSOEVER, INCLUDING, WITHOUT LIMITATION, THE CONDITION OF THE EQUIPMENT, ITS MERCHANTABILITY, ITS DESIGN, ITS CAPACITY, ITS PERFORMANCE, ITS MATERIAL, ITS WORKMANSHIP, ITS FITNESS FOR ANY PARTICULAR PURPOSE, OR THAT IT WILL MEET THE REQUIREMENTS OF ANY LAWS, RULES, SPECIFICATIONS, OR CONTRACTS WHICH PROVIDE FOR SPECIFIC APPARATUS OR SPECIAL METHODS. TOPLENSRENTAL FURTHER DISCLAIMS ANY LIABILITY WHATSOEVER FOR LOSS, DAMAGE, OR INJURY TO RENTER OR THIRD PARTIES AS A RESULT OF ANY DEFECTS, LATENT OR OTHERWISE, IN THE EQUIPMENT. AS TO TOPLENSRENTAL, RENTER LEASES THE EQUIPMENT “AS IS”. TOPLENSRENTAL SHALL NOT BE LIABLE IN ANY EVENT TO Lessee FOR ANY LOSS, DELAY, OR DAMAGE OF ANY KIND OR CHARACTER RESULTING FROM DEFECTS IN, OR INEFFICIENCY OF, EQUIPMENT HEREBY LEASED OR ACCIDENTAL BREAKAGE THEREOF.
Tax or duties
Sale taxes will be applied for any shipments in California. Applicable sales or other transaction taxes imposed on us in connection with your order will be included in your fees.
Ownership
The Equipment is and shall remain the exclusive property of TopLensRental.com
Default
If the renter fails to meet any obligation under this agreement, TopLensRental has full right to take immediate possession of the equipment, to make a charge to the renter’s credit card for the replacement value of the equipment, to pursue any legal remedies and to sue to recover any lost equity or income. The renter is held responsible for all court costs and legal fees incurred by TopLensRental.
TopLensRental shall have the right to exercise any one or more of the following remedies.
(a) To declare the entire amount of rent hereunder immediately due and payable as to any or all items of the equipment, without notice or demand to renter.
(b) To sue for and recover all rents, and other payments, then accrued or thereafter accruing, with respect to any or all items of his equipment.
(c) To take possession of any or all items of the equipment without demand, notice, or legal process, wherever they may be located. Renter hereby waives any and all damages occasioned by such taking of possession.
(d) To terminate this lease as to any or all items of equipment.
(e) To pursue any other remedy at law or in equality. Renter shall be and remain liable for the full performance of all obligations on the part of renter to be performed under this Lease.
Entire Agreement
This term & condition contract is set for the entire understanding and agreement between these two parties. If any portion of this term & condition contract is found unenforceable, it will not affect the remainder of the contract, which shall remain valid and enforceable. The agreement shall be enforced according to the laws of Los AngelesCounty, the state of California.
